SUBMISSION OF TEMPORARY RESIDENCE APPLICATION

Application for temporary residence approval is either submitted to the Police Directorate for the City of Belgrade-Directorate for Foreign Nationals or regional Police directorates оr by eGovernment portal, depending on either a foreign national’s short-term residence address or a residential address, i.e., to organizational units in charge of residence and movement of foreign nationals in the Republic of Serbia.

The application for either approval or extension of temporary residence shall be submitted in person followed by complete documentation i.e., all prescribed proofs. The application may be supplemented by additional proofs if requested by an authorized official.

The application for the extension of temporary residence shall be submitted no earlier than three months and no later than expiration of an approved temporary residence permit.

The personal identification document, which is enclosed with the application form, shall be valid for at least three months longer compared to the period for which temporary residence is granted.

A foreign national shall reside in the Republic of Serbia in accordance with the purpose for which his/her temporary residence has been approved.

DOCUMENTATION REQUIRED FOR TEMPORARY RESIDENCE APPROVAL

1. Based on employment:

Employment

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• extract on registration of either a legal entity or entrepreneur in the Republic of Serbia
• employment contract, fixed-term temporary contract or other contract proving the employment of a foreign national in the Republic of Serbia in accordance with labor regulations;
• report by the employment agency on the fulfillment of employment conditions if the employment is established for the first time, i.e., a work permit if a temporary residence is extended.

Employment - a person registered in the Registration decision

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• extract on registration of either a legal entity or entrepreneur in the Republic of Serbia;

Employment - business and technical cooperation agreement with a foreign legal entity for a foreign national referred to work in the Republic of Serbia

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• extract on registration of a legal entity in the Republic of Serbia

• business-technical cooperation agreement entered with a foreign legal entity
• decision of a foreign legal entity on referring or delegating employees to a legal entity registered in the Republic of Serbia, unless otherwise regulated in the business and technical cooperation agreement
• certificate of a legal entity registered in the Republic of Serbia, i.e., certificate of a foreign national’s employment
• decision copy - work permit if a temporary residence is extended.

Employment - a foreign national who works at a company registered abroad for the purpose of his/her temporary referral, i.e., relocation to a legal entity registered in the Republic of Serbia

• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• extract on the registration of a legal entity in the Republic of Serbia;
• decision of a foreign legal entity on either referring or delegating employees to a legal entity registered in the Republic of Serbia;
• certificate of a legal entity registered in the Republic of Serbia, i.e., certificate of a foreign national’s employment
• decision copy - work permit if a temporary residence is extended

Employment - professional engagement in a sports club

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• extract on the registration of a sports club in the Republic of Serbia;
• contract on a foreign athlete’s engagement certified by the competent sports federation
• decision copy - work permit if a temporary residence is extended

Employment – volunteer

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• extract on the registration of a legal entity in the Republic of Serbia
• volunteer agreement
• certificate by the state body that the volunteer organizer is registered in the prescribed records of the volunteer organizer

Employment - accredited foreign journalist

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• accreditation by the Ministry of Culture and Information in the Republic of Serbia

Employment - experts engaged in the project implementation in cooperation with other government agencies

• filled out application form for the approval/extension of temporary residence

• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• letter by the competent state body, local self-government unit, other organization or association on the need to engage a foreign national, his/her job position and duration of work engagement

2. Based on education:

Education - studying - learning the Serbian language

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport

• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence
• certificate of enrollment in a verified primary or secondary school, i.e. accredited higher educational institution;
• certificate of enrollment in an organization registered for other types of education or language learning (provided that it is the learning of the Serbian language);
• extract on the registration of either a legal entity or entrepreneur in the Republic of Serbia in which it is clearly stated that such legal entity or entrepreneur is engaged in education as its predominant activity, i.e., a certificate proving that the educational institution is either verified or accredited in the Republic of Serbia;

Participation in international student exchange programs

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence
• extract on the registration of a legal entity in the Republic of Serbia;
• certificate of enrollment in a verified primary or secondary school, i.e. accredited higher educational institution within the international student exchange program and proof that the international student exchange program is approved by the ministry responsible for education and science

Specialization, professional training or practice

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence

• extract on the registration of a legal entity in the Republic of Serbia;
• certificate of a legal entity that organizes specialization, training or practice in the Republic of Serbia by clearly stating the date of both the beginning and end of specialization, professional training and practice
• decision copy - work permit when a temporary residence is extended, depending on the nature of work engagement

Scientific research or other scientific educational activities

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence
• extract on the registration of an accredited scientific research organization in the Republic of Serbia where a foreign national conducts either scientific research or other scientific educational activity;
• contract entered with a scientific-research organization on the performance of scientific-research and implementation of research activities
• certificate by the institution, i.e. legal entity where a foreign national conducts scientific research or other scientific educational activities followed by the exact date of both the beginning and end of scientific research or other scientific educational activities
• decision copy - work permit when a temporary residence is extended

3. Based on family reunification:

Family reunion – marriage

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• marriage certificate not older than 6 months (spouse - citizen of the Republic of Serbia)
• document proving the marriage to a foreign national in compliance with the national legislation of the country where the marriage was solemnized (spouses - foreign nationals)
• proof of means of subsistence during the planned temporary residence (not submitted by a foreign national who is an immediate family member of the citizen of the Republic of Serbia and a member of an immediate family of a foreign national who is being employed)
• proof of health insurance during the planned residence (not submitted by a foreign national who is an immediate family member of the citizen of the Republic of Serbia and a member of an immediate family of a foreign national who is being employed)

Family reunion – common-law partners

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• single status certificate for both partners
• other proofs of the existence of a common-law marriage (statements made by common-law partners and certified statements by two witnesses on a more permanent cohabitation, proof of a common residential address, i.e., an extract on the register of a common-law marriage, if it is registered in the country where a common-law marriage was entered into, etc.)
• a birth certificate for the child if a child was born in a common-law marriage

• proof of means of subsistence during the planned temporary residence (not submitted by a foreign national who is an immediate family member of the citizen of the Republic of Serbia and a member of an immediate family of a foreign national who is being employed)
• proof of health insurance during the planned residence (not submitted by a foreign national who is an immediate family member of the citizen of the Republic of Serbia and a member of an immediate family of a foreign national who is being employed)

Family reunion - for a minor

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• child’s birth certificate
• presence of both parents is required. If it is not possible to ensure the presence of both parents, the certified consent of the other parent shall be enclosed.

• proof of means of subsistence during the planned temporary residence (not submitted by a foreign national who is an immediate family member of the citizen of the Republic of Serbia and a member of an immediate family of a foreign national who is being employed)
• proof of health insurance during the planned residence (not submitted by a foreign national who is an immediate family member of the citizen of the Republic of Serbia and a member of an immediate family of a foreign national who is being employed)

Legal representatives (parents, guardians) of children born in the Republic of Serbia, who have been granted temporary residence, shall submit an application form for temporary residence for a child within 90 days of the child's birth.

Family reunion - with a foreign national who has been granted asylum in the Republic of Serbia

• filled out application form for the approval/extension of temporary residence

• registration of either short-term or residential address in the Republic of Serbia

• a copy of the decision on granted asylum in the Republic of Serbia for a close family member based on which he/she shall submit an application form for temporary residence
• other proof of kinship at his/her disposal
• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence

4. Miscellaneous:

Independent temporary residence

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia

• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence

• proof i.e. documentation proving that he/she had been granted temporary residence based on family reunion in the previous four years
• death certificate for the deceased family member, i.e. divorce decree (if a spouse passed away, or divorce occurred)
• proof that criminal proceedings have been initiated against a close family member for committing the criminal offense of domestic violence, i.e. that a close family member has been convicted of such criminal offense (victim of domestic violence)
• document issued by the competent Center for Social Work proving that measures were taken within its competence during the validity of a foreign national’s temporary residence based on a family reunion to protect a foreign national from domestic violence, or the document issued by a safe shelter proving that during the validity of a foreign national’s temporary residence based on a family reunion the applicant was accommodated in their premises for the purpose of protecting him/her against a close family member, who has been repeatedly reported to the police, prosecutor's office or other state bodies, due to the existence of reasonable grounds that he/she has committed the criminal offense of domestic violence (victim of domestic violence).

Performing religious ceremony

• proof of means of subsistence during the planned temporary residence

• employment contract or a letter by a registered church or religious community in the Republic of Serbia stating that a foreign national is engaged in the capacity of a priest or a religious official

Medical treatment

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• proof of means of subsistence during the planned temporary residence
• proof of health insurance during the planned residence
• decision on the registration of a health care institution in the Republic of Serbia
• a letter by the health care institution stating the place of treatment and the need for continuous treatment for a certain period of time
• decision on the registration of a social welfare institution in the Republic of Serbia and a work license issued by the body responsible for social welfare (in the event of patient care)

Real estate ownershi

• filled out application form for the approval/extension of temporary residence

• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• proof of means of subsistence during the planned temporary residence

Exceptionally, other document proving ownership can also be considered as proof (certified real estate purchase agreement, deed of gift, probate decision, court decision, etc.)

5. Categories of foreign nationals who can be granted temporary residence irrespective of the grounds for granting a temporary residence:

“Startup”

Foreign nationals having founded a company in the Republic of Serbia and whose innovative activity has been recognised by a registered Science and Technology Park, of which the Republic of Serbia, an autonomous province, the city of Belgrade or a local self-government unit is one of the founders

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• a document issued by a registered Science and Technology Park by which a business company’s activity, founded by a foreign national in the Republic of Serbia, is confirmed and thereby recognized as an innovative activity

The first temporary residence shall be approved for a period of one year, therefore one of the following documents specified below shall be enclosed when submitting a request for an extension of a temporary residence:

• proof of an established employment relationship with one or more citizens of the Republic of Serbia over the course of validity period of a previously approved temporary residence that exceeds the period of time for which the extension of temporary residence has been requested, or

• proof that the business company, which has been established for innovative activity purposes, has attained minimum business income in the amount of RSD 1,000,000.00 during the validity period of previously valid temporary residence, or

• a document issued by a Science and Technology Park by which a company’s active engagement in innovative activities is confirmed

 Investor

Foreign nationals investing in an already registered company in the Republic of Serbia, i.e. in the company’s activity through basic tangible and intangible assets

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• either a certificate of or a excerpt on the possession of funds on a bank account at a bank registered in the Republic of Serbia in the amount of at least EUR 50,000.00 i.e. in the equivalent value in either RSD or other foreign currency

The first temporary residence shall be approved for a period of six months, and one of the following documents below shall be enclosed when submitting a request for an extension of a temporary residence:

• proof of paid cash capital contribution in the amount of at least EUR 5,000.00 or equivalent value in either RSD or other foreign currency to the share capital of an already registered company

Talent

Foreign nationals holding a decision on professional recognition of a tertiary education certificate issued by the competent authority of the Republic of Serbia:

• filled out application form for the approval/extension of temporary residence
• a valid personal or official passport
• two photos (35x45mm, color, full face)
• proof of prescribed administrative fee payment
• registration of either short-term or residential address in the Republic of Serbia
• decision on professional recognition of a tertiary education certificate issued by the competent authority of the Republic of Serbia

The first temporary residence shall be approved for a period of one year, and one of the following documents specified below shall be enclosed when submitting a request for an extension of a temporary residence:

• employment contract, temporary service contract or other contract by which the employment of a foreign national in the Republic of Serbia is evidenced in compliance with labor regulations

• certificate of a legal entity’s registration in the Republic of Serbia issued over the course of a validity period of previously valid temporary residence, of which a foreign national is one of the founders

Serbian origin

Applicant’s Serbian origin is considered either a blood or adoptive kinship with an ancestor in a direct line who is either a citizen of the Republic of Serbia or a citizen of predecessor countries of the Republic of Serbia, i.e. of a country of which the Republic of Serbia is a legal successor, i.e. who either declares or has declared as a Serb.

• either a domestic public document or a foreign public document that has a probative value of a domestic public document in compliance with the law, and by which it can be determined the applicant's Serbian origin
• baptism record by the Serbian Orthodox Church issued by either a diocese or parish of the church by which the applicant’s Serbian origin, i.e. his/her ancestor’s Serbian origin can be determined

The first temporary residence shall be approved for a period of one year, and one of the following documents below shall be enclosed when submitting a request for an extension of a temporary residence:

• employment contract, temporary service contract or other contract by which the employment of a foreign national in the Republic of Serbia is evidenced in compliance with labor regulations
• certificate of a legal entity’s registration in the Republic of Serbia issued over the course of validity period of previously valid temporary residence, of which a foreign national is one of its founders
• certificate of real estate acquisition in the territory of the Republic of Serbia
• certificate of foreign income
• certificate on the use of right to a foreign pension

ADDITIONAL INFORMATION

Proof of administrative fee payment shall not be enclosed if the application form is submitted on the eGovernment portal since the app creates payment slips automatically, therefore the fee shall be paid in a way defined on the app itself (by payment card).

Payment slips intended for administrative fee payment shall be created on the eGovernment portal by selecting the option СТРАНЦИ (FOREIGN NATIONALS) after entering a name and surname, identity number and short-term residence/residence address.

Proof that a foreign national has secured means of subsistence shall be considered as follows:

• salary certificate (salary slip, etc.);
• employment contract, fixed-term temporary employment contract or other contract proving the employment of a foreign national in the Republic of Serbia in accordance with labor regulations;
• proof of pension insurance payments;
• proof of entry on the Register of Agricultural Holdings;
• certificate of or extract on bank account funds of a bank registered in the Republic of Serbia in the amount of the minimum salary in the Republic of Serbia;
• a guarantee by either an employer or a natural person who is a member of a foreign national’s household, who has submitted an application for permanent residence approval and who shall incur the costs of supporting a foreign national;

Proof that a foreign national has health insurance shall be considered as follows:

• European health insurance card, i.e. another document proving that a foreign national is insured in their country of origin, in accordance with the regulations of the Republic of Serbia on health insurance;
• a foreign national’s health insurance policy;
• proof of funds that can cover the costs of emergency medical care, or treatment of chronic diseases;
• a guarantee from either an employer or a natural person that he/she shall cover the costs of emergency medical care, i.e. treatment of chronic diseases;
• valid health insurance card of the Republic of Serbia.

Proof not issued by the competent authorities of the Republic of Serbia shall be translated by an authorized court translator.

Statements made by a foreign national, which serve as proof of fulfillment of the appropriate legal conditions for granting temporary residence or permanent residence, shall be certified by a notary public.
